1. Application scope
1.2. This Policy is construed in accordance with the Regulation (EU) 2016/679 of European Parliament and Council (General Regulation on Data Protection) which has entered into the force on 25 May 2018 and other legal acts regulating the data protection in the Republic of Croatia.
1.3. Personal data is each data related to an identified or identifiable person. Accordingly, this Policy will be applied to all visitors of the web page – private persons, while it will be applied to the visitors of the web page – business entities only to the extent applicable for the private persons (e.g. name and surname and contact data of the contact person within the business entity)
2. Basic principles and legal basis for personal data processing
2.1. INGEMARK processes the visitors’ personal data taking into account the following personal data protection principles:
– personal data is processed in a lawful, fair and transparent manner,
– personal data is collected for specified, explicit and legitimate purposes and not further processed in a manner that is incompatible with those purposes,
– personal data is adequate, relevant and limited to what is necessary in relation to the purposes for which they are processed,
– personal data is accurate and, where necessary, kept up to date; every reasonable step must be taken to ensure that personal data that are inaccurate, having regard to the purposes for which they are processed, are erased or rectified without delay,
– personal data can be kept in a form which permits identification of data subjects for no longer than is necessary for the purposes for which the personal data are processed,
– personal data is processed in a manner that ensures appropriate security of the personal data, including protection against unauthorized or unlawful processing and against accidental loss, destruction or damage, using appropriate technical or organizational measures
2.2. INGEMARK can process the visitors’ personal data on one of the following legal basis:
– processing is necessary for the performance of a contract to which the visitor is party or in order to take steps at the request of the visitor prior to entering into a contract;
– processing is necessary for compliance with a legal obligation to which INGEMARK is subject;
– processing is necessary in order to protect the vital interests of the visitor or of another natural person;
– processing is necessary for the performance of a task carried out in the public interest;
– processing is necessary for the purposes of the legitimate interests pursued by INGEEMARK or by a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject which require protection of personal data
3. For which purposes and on which basis does Ingemark process the visitors’ personal data?
This web page processes the personal data as it follows:
- via newsletter form
- via contact form
- via cookies
3.1. Newsletter form
INGEMARK will periodically send a newsletter to the visitors who have subscribed to it. Legal basis for sending the newsletter messages is explicit consent.
The visitors can at any time withdraw their consent i.e. unsubscribe from the list of newsletter recipients. Unsubscribing does not affect the lawfulness of INGEMARK’s actions at the time before the consent is withdrawn.
3.2. Contact form
The personal data sent by the visitor to INGEMARK via contact form will be visible and accessible only to INGEMARK’s authorized persons and will be processed only for the purpose of responding to the inquiry sent by the visitor via contact form.
3.3. Cookies
Web-page uses cookies. The cookie is information which visited internet page stores in the computer of the visitor. The cookies are not directed to spying the visitor and don’t represent the malicious code or virus. Also, the cookies are not connected to spam messages. Some kinds of cookies are intended for marketing and advertising, and some of them are not. The information such as visitors’ names and other information with which it would be possible to identify the visitor will not be stored. INIGEMARK is not able to access the personal information or files on visitors’ computers.
- Functional cookies – INGEMARK uses these cookies to make web-page functional i.e. for purposes of enabling normal searching and using all its functionalities. For example, these cookies enable moving to sub-pages or sending the inquiry via contact form in a functional manner. Also, these are the “session cookies” meaning that they are stored on the visitor’s computer only during the visit to this web-page, after which they are erased. The visitor does not have an option to manage functional cookies by adapting the functionalities of web-browsers or by adapting the functionalities on web-page. The functional cookies activity is an inevitable condition for visiting the web-page. Therefore, we don’t require the consent from the visitors for using the functional cookies.
- Analytical/statistical cookies – This web-page collects your IP address, time of the visit to the web-page as well as the time spent on it, information on the accessed content, as well as information on device model from which you perform the access. This web-page doesn’t collect your personal data by which you could be identified, such as visitor’s name, email address and similar. The purpose of using these tools is to, without revealing the visitors’ identity, establish the visiting statistics in order to understand which content visitors like the most, in order to develop this web-page accordingly and, to the extent possible, make it informative and adapted to visitors’ needs. The visitor can manage analytical/statistical cookies in the cookie tab [link]. These cookies will be activated after the visitor gives its consent for the activation. The visitor can withdraw the consent at any time.
- Marketing cookies – these cookies are used for the purposes of collecting the data related to visitor’s general behavior on the Internet i.e. track the visitor’s actions in the course of browsing the web-pages. INGEMARK uses the marketing cookies for collection of data on habits and interest of the visitors and in that manner shows to the visitor the advertisements that might be relevant. If the visitor disables this kind of the cookies, the advertisement will still be shown, but won’t be adapted to visitor’s needs i.e. will be less relevant. The visitor can manage the marketing cookies in the cookie tab [link]. These cookies will be activated after the visitor gives its consent for the activation. The visitor can withdraw the consent at any time.
4. Photographs
4.2. INGEMARK can take photos during these events with the purpose of publishing the photos on web-page and/or social media, with the purpose of informing the public of the event.
4.3. By coming to the event, the visitor confirms that it is familiar that the event might be photographed and that the photos might be published at the INGEMARK’s web-page. In case where the visitor wants to object to such data processing, the visitor can file the objection on the email privacy@ingemark.com.
5. Links to other web-pages and social media
5.2. INGEMARK can not warrant and is not liable for personal data protection status on such web-pages and/or social media. The visitors are due to get familiar with the privacy policy at those pages and/or social media and use it on their own liability. INGEMARK will not bear any liability for any unlawfulness, including the lack of compliance of the web pages and/or social media with the Regulation.
6. In which time period does Ingemark process the visitors’ personal data?
7. Visitors’ rights; Realization of rights
7.1. The visitor has a right to the access, deletion and limitation of personal data processing. The visitors can object to processing the personal data processed on the basis of the legitimate interest. The visitors can, at any time, waive the consent for the processing based on consent.
7.2. The visitors can get the information on collection of personal data, as well as to file objections and requests for the realization of the personal data rights through contact form at web-page or by sending the inquiry at email privacy@ingemark.com. The visitors can file the objection to the Supervisory body in the Republic of Croatia – Agency for Personal Data Protection via email azop@azop.hr or to the Supervisory body in the country of the visitor’s domicile.
8. Miscellaneous
8.1. INGEMARK reserves the right to amend and supplement this Policy.
8.2. All amendments and supplements of this Policy will be created and published
8.3. in the same manner as this Policy. The visitors will be informed of the amendments and supplements during the first next visit to INGEMARK’s web page.
